Terms of Service

The following terms and conditions govern all use of the f5bot.com website and all content, services and products associated with the f5bot.com website (collectively, the "Service")

The Service is owned and operated by Silo 9 Inc.

The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time by Silo 9 Inc (collectively, the "Agreement"). To be eligible to use the Service you must review and accept this Agreement by clicking on the "I Accept" button or other mechanism provided.

PLEASE REVIEW THESE TERMS CAREFULLY. ONCE ACCEPTED, THESE TERMS BECOME A BINDING LEGAL COMMITMENT BETWEEN YOU AND Silo 9 Inc.

In this Agreement, "we," "us," "our" or "Silo 9" will refer to Silo 9 Inc. The terms "you," "your" and "Customer" will refer to you. If you are registering or using the Service on behalf of an organization, you are agreeing to these terms for that organization and promising Silo 9 Inc that you have the authority to bind that organization to these Terms (and, in which case, the terms "you," "your" and "Customer" will refer to that organization). The exception to this is if that organization has a separate contract with Silo 9 Inc covering your account and use of our Services, in which case that contract will govern your account and use of the Service.

IMPORTANT NOTE: SILO 9 INC DOESN'T PROVIDE WARRANTIES FOR ITS SERVICES, AND THESE TERMS LIMIT OUR LIABILITY TO YOU.

  1. Changes

    1. Silo 9 Inc reserves the right, at its sole discretion, to modify or replace any part of this Agreement.

    2. Silo 9 Inc may also, in the future, offer new services, products, and/or features through the Service. Such additions shall be subject to the terms and conditions of this Agreement.

    3. Silo 9 Inc reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

  2. Your Account

    1. You must of legal age to form a binding contract and not be barred from receiving such services under the laws of the United States or other jurisdictions.

    2. You are responsible for maintaining the security of your Account and password.

    3. You must immediately notify Silo 9 Inc of any unauthorized uses of your Account or any other breaches of security. Silo 9 Inc will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

    4. You are fully responsible for all activities that occur under the Account and any other actions taken in connection with the Account.

    5. You are required to provide current and factual identification, contact and other information as part of the registration process.

    6. You agree to keep your contact information updated for your account, including, but not limited to, your name and email address.

  3. Intellectual Property

    1. The Agreement does not transfer from Silo 9 Inc to you any Silo 9 Inc or third party intellectual property, and all right, title and interest in and to such property will remain solely with Silo 9 Inc.

    2. Silo 9 Inc the Silo 9 Inc logo, and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or registered trademarks of Silo 9 Inc or Silo 9 Inc licensors.

    3. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of other third parties.

    4. Your use of the Service grants you no right or license to reproduce or otherwise use any Silo 9 Inc or third-party trademarks.

    5. You consent to Silo 9 Inc using your name, company name, and company logo for marketing purposes. You also agree to allow Silo 9 Inc to publicly claim that you are a user of the Service.

  4. Termination

    1. Silo 9 Inc may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately.

    2. Termination of Service may result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all data and content in your Account.

    3. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

    4. Silo 9 Inc shall not be liable to you, or to any third party, for any modification, price change, suspension or discontinuance of the Service.

  5. Disclaimer of Warranties

    1. The Service is provided "as is". Silo 9 Inc and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Silo 9 Inc nor its suppliers and licensors, makes any warranty that the Service will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Service at your own discretion and risk.

  6. Limitation of Liability

    1. In no event will Silo 9 Inc or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for:

    2. any special, incidental or consequential damages

    3. the cost of procurement for substitute products or services

    4. for interruption of use or loss or corruption of data

    5. for any amounts that exceed the fees paid by you to Silo 9 Inc under this agreement during the twelve (12) month period prior to the cause of action.

    6. Silo 9 Inc shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

  7. General Representation and Warranty

    1. You represent and warrant that:

    2. your use of the Service will be in strict accordance with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside)

    3. your use of the Service will not infringe or misappropriate the intellectual property rights of any third party.

  8. Entire Agreement

    1. This Agreement constitute the entire agreement between you and Silo 9 Inc and governs your use of the Service, superseding any prior agreements between you and Silo 9 Inc for the use of the Service.

  9. Choice of Law and Forum

    1. This Agreement and the relationship between you and Silo 9 Inc shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws provision. You and Silo 9 Inc agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Lee, Iowa.

  10. Waiver and Severability

    1. The failure of Silo 9 Inc to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.

  11. Statute of Limitations

    1. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Service or Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
